Silent No More

The number of employment retaliation claims filed with the EEOC has increased almost every year since 1997, from 18,198 new claims in FY 1997 up to 39,469 new claims in FY 2018. Retaliation claims are incorporated into 49% of all claims received by the agency. Now more than ever, employees find themselves unwilling to quietly endure misconduct that would have been de jure half a generation ago. In the face of cultural flux and a rising tide of claims, Oregon Supreme Court Justice Martha Walters will discuss last year’s landmark employment law case that dramatically expanded the scope of Oregon’s anti-retaliation provision.
